Terms of UsePrivacy PolicyHow Bidness is paid

Terms of Use

These terms apply to everyone who uses Bidness at joinbidness.com. Bidness is operated by Bidness LLC, a Texas limited liability company ("Bidness", "we"). By creating an account, you agree to these terms.

1. What Bidness is, and is not

Bidness is an introduction service. We help borrowers and licensed mortgage lenders find each other.

  • We are not a lender, mortgage broker, loan originator or loan officer.
  • We do not take loan applications, make credit decisions, set rates or fees, or give financial, legal or tax advice.
  • A scenario on Bidness is not a loan application. Only a lender's official Loan Estimate shows real loan terms.

2. Accounts

  • You must be at least 18 and able to enter a contract.
  • One person per account. Keep your email secure: anyone who can read it can sign in with the one-time code we send.
  • Borrowers and lenders need separate accounts with different emails.
  • You can close your account at any time by contacting us at support@joinbidness.com.

3. For borrowers

  • Using Bidness is free. You never pay us to post, chat or choose.
  • Your scenario is shown to approved lenders licensed in your state, without your name, phone or email.
  • Please keep your story free of names, addresses, phone numbers, emails and account numbers. We remove phone numbers, emails and links automatically, but we cannot catch everything.
  • You are never required to choose a lender. If you choose one, we share your name, email and phone (if you gave it) with that lender, and their name, company, NMLS ID and contact details with you.
  • Lenders' pitches, rates, fees and fee sheets are their own statements, not ours. Compare official Loan Estimates before you decide.

4. For lenders

  • You must hold, and keep current, every license required to originate mortgages in each state you select, and give us your accurate individual NMLS ID. We may check it at any time and pause your account if it is inactive or does not match.
  • Pitches, chats and fee sheets may include rates, points, fees or savings at your discretion. You are solely responsible for following federal and state mortgage advertising and disclosure rules, including showing the APR whenever you state a rate, and for keeping every figure accurate for that borrower.
  • A fee sheet is an informal estimate, not a Loan Estimate. Do not label it or format it to look like one.
  • Do not ask for or share contact details, or try to identify or contact a borrower, before they choose you.
  • Exported scenario files are for pricing and preparing your pitch only. Do not pull credit or market to the borrower from them, and delete them if another lender is chosen.
  • Pitches count toward a monthly allowance. You pay one flat monthly subscription after any free period; see How Bidness is paid.

5. Ratings and feedback

  • Only a borrower who chose a lender can rate that lender. We publish ratings that follow these terms, positive or negative, and lenders cannot pay to change or remove them.
  • Borrowers may send private, anonymous reasons to lenders they did not choose. These never affect public ratings.
  • Feedback must be honest, about your own experience, and free of personal details.

6. What is not allowed

Spam or made-up scenarios; harassment; discrimination prohibited by fair lending laws; sharing contact details before a choice; scraping or automated access; impersonating anyone; trying to get around our safeguards; or any unlawful use.

7. Our role and safety

  • We may review scenarios, pitches and chats to keep the service safe and to enforce these terms.
  • We may remove content, pause or close accounts, and report unlawful activity.
  • You can report a problem at support@joinbidness.com. We review every report and may contact the people involved.

8. Messages from us

We email you about your account and activity: sign-in codes, new scenarios in your states, new pitches, new messages, choices and approvals. These are part of the service. If we add text alerts, we will ask for your separate consent first, and you can reply STOP at any time to end them.

9. Disclaimers and limits

  • No warranties. Bidness is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
  • No guarantees. We do not guarantee that you will receive pitches, be approved for a loan, get any rate or terms, or that information from other users is accurate or complete. Pitches, fee sheets and chat messages are the statements of the lenders and borrowers who make them.
  • Limit of liability. To the fullest extent the law allows, Bidness and its owners, employees and service providers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, savings or data. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $100.
  • Where the law differs. Some states do not allow some of these limits. They apply to you only as far as your state's law allows.
  • Lender indemnity. Lenders will defend, indemnify and hold Bidness harmless from claims, losses and costs (including reasonable attorneys' fees) arising from their pitches, fee sheets, communications, loan products, licensing, or any violation of law or these terms.

10. Disputes and changes

  • Governing law. These terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules.
  • Talk to us first. Before filing a claim, email legal@joinbidness.com with a description of the dispute. We both agree to try in good faith to resolve it within 30 days.
  • Arbitration. If we cannot resolve it, any dispute will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (Commercial Arbitration Rules for lenders). Hearings may be held by video or in the county where you live. Either side may instead bring an individual claim in small claims court.
  • No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative action.
  • Opting out. You may opt out of arbitration by emailing legal@joinbidness.com within 30 days after you first accept these terms.
  • Courts. Any matter not subject to arbitration will be decided in the state or federal courts located in Texas.
  • Changes. We may update these terms. For material changes we will email account holders at least 14 days before they take effect. Continuing to use Bidness after that date means you accept the updated terms.
  • General. We may suspend or end access for violations of these terms. If any part of these terms is found unenforceable, the rest still applies. Not enforcing a term is not a waiver. These terms, the Privacy Policy and How Bidness is paid are the entire agreement between you and Bidness about the service.
